Can I still contribute to my 401k while Im in Bankruptcy?
Yes and No.
Technically, you can still voluntarily contribute to a 401k or other retirement account. However, the Ninth Circuit appeals court ruled that Chapter 13 debtors could not
voluntarily contribute to retirement accounts at the expense of their
creditors. As a result we’re not able to deduct those contributions from
your disposable income in your filed budget. With this, it will lead your Trustee to believe you have more funds available
to pay your debt.
